Setia Lenscape Photography Contest — Terms and Conditions

The terms and conditions stated herein shall govern the Contest organised by the Organiser (“Terms and Conditions”). By participating in the Contest, each Participant shall be deemed to have read, understood, accepted and agreed to be bound by these Terms and Conditions, including any amendments or variations thereto, and shall unequivocally accept the same in their entirety.

1. Organiser

   *S P Setia (collectively, the “Organiser”)

2. Name of the Contest

   Setia Lenscape Photography Contest (“Contest”)

3. Eligibility Criteria

   The Contest is open to individuals only who are Malaysians or permanent residents residing in Malaysia, aged eighteen (18) years and above, and who are not bankrupt at the time of entry.

   For the avoidance of doubt, participation in the Contest is not open to companies, partnerships, associations, societies or other entities.

4. Ineligibility
   1. The following persons are not eligible to participate in the Contest:
      1. employees of the Organiser or any of its affiliates, subsidiaries or related companies within the S P Setia Berhad Group, whether employed on a part-time, full-time, permanent or contractual basis, including their immediate family members;
      2. employees of the Organiser and/or any company within the S P Setia Berhad Group who have tendered their resignation or retired at any time during the Contest Period, including their immediate family members; and
      3. employees of the advertising, media, creative and promotional agencies who are directly involved in the Contest, including their immediate family members; and
      4. employees of service providers and vendors engaged by the Organiser in connection with the Contest, including their immediate family members.

   For the purposes of this Clause, “immediate family members” shall include spouses, children, parents, siblings or any other persons under such employees’ guardianship.

5. Contest Period and Contest Mechanism
   1. The Contest Period commences on 6 July 2026 (Monday) at 12:01 a.m. (Malaysia time) and ends on 31 August 2026 (Monday) at 11:59 p.m. (Malaysia time) (both dates inclusive), unless otherwise notified by the Organiser via its official communication channels (“Contest Period”). The Organiser reserves the right to vary, postpone, reschedule or extend the Contest Period at its sole and absolute discretion. Any such change shall be communicated via the Organiser’s official communication channels.
   2. Only a person who satisfies the Eligibility Criteria set out in Clause 3 and complies with these Terms and Conditions shall be eligible to submit an entry and participate in the Contest (“Participant”).
   3. There are two (2) categories of Participants in the Contest (each, a “Participant Category”). Each Participant must indicate the relevant Participant Category at the time of submission:

   4. Each Participant may submit entries under one (1) or both of the following themes (each, a “Contest Theme”):

      1	Life in Setia (Community, Lifestyle & Green Living): This theme focuses on life in motion—Live, Learn, Work, Play—and highlights that Setia townships and projects are not merely physical developments, but vibrant, dynamic and thriving communities.
      2	Iconic Setia (Architecture, Landscape & Design): This theme focuses on the “wow” factor by showcasing cinematic shots of Setia’s signature architecture, landscaping and master-planned township designs.

   5. Each entry submitted by a Participant must comply with all of the following criteria:
      1. A Participant may submit a maximum of five (5) photographs per Contest Theme. For the avoidance of doubt, if a Participant submits entries for both Contest Themes, the maximum total number of photographs that may be submitted by that Participant is ten (10) photographs;
      2. Each Participant may submit more than one (1) entry during the Contest Period. Notwithstanding the foregoing, each Winner shall only be entitled to one (1) Prize under the Contest, regardless of the number of entries submitted;
      3. Each submitted photograph must:
         1. correspond to the description of the selected Contest Theme;
         2. be taken at a property or unit within a development or project developed or undertaken by the Organiser or any company within the S P Setia Berhad group of companies;
         3. be at least 3 MB and not exceed 10 MB in file size;
         4. be an original work created and captured by the Participant and not copied, reproduced or derived from any third-party work;
         5. not be generated by artificial intelligence (AI) and not contain any AI-generated or AI-manipulated element that alters the authenticity of the image, including generative fill, compositing, or the addition or removal of subjects or background elements by AI tools;
         6. not have been published for commercial purposes, submitted in any other contest or competition that is pending, underway or not yet finally determined, or won any prize in any other contest or competition at the time of submission to this Contest;
         7. not contain any third-party logo, trademark, signage or material in a manner that is prominent, deliberate or capable of giving rise to infringement, unless the Participant has first obtained all necessary licenses, consents and permissions and is able to produce evidence of the same upon the Organiser’s request;
         8. not infringe the intellectual property rights, privacy rights, image rights or other rights of any third party; and
         9. not contain any unlawful, defamatory, obscene, indecent, offensive, discriminatory or inappropriate content.
   6. All entries must be submitted through the official Contest microsite at https://setia-lenscape-contest.edgeprop.my/ or such other submission channel designated by the Organiser, together with all required particulars and supporting documents as may be prescribed by the Organiser. Any incomplete, illegible, corrupted, late or improperly submitted entry may be rejected by the Organiser at its sole discretion.
   7. The Organiser reserves the right at any time to require the Participant to produce the original file, RAW file, EXIF data, metadata, location details, date and time of capture and/or such other supporting evidence as the Organiser may require to verify the authenticity, authorship, eligibility and compliance of any submitted photograph. Failure or refusal to provide the same within the timeframe prescribed by the Organiser may result in the relevant entry being disqualified without any liability on the part of the Organiser.
   8. Basic post-processing, including cropping, colour correction, exposure adjustment, contrast adjustment and minor retouching, is permitted provided that such editing does not materially alter, manipulate or misrepresent the original scene, subject matter, location, background or context of the photograph. Any composite image, staged image, AI-generated image, AI-manipulated image, digitally altered image or photograph which, in the Organiser’s opinion, compromises the authenticity or integrity of the submitted photograph may be disqualified.
   9. By entering the Contest, each Participant represents, warrants and undertakes that all necessary consents, permissions and releases required from any identifiable person appearing in the submitted photograph have been duly obtained by the Participant. Where any such person appearing in the submitted photograph is below eighteen (18) years of age, the Participant shall obtain the prior written consent of that person’s parent or legal guardian. The Participant shall provide documentary proof of such consent upon the Organiser’s request.
   10. The Participant retains ownership of the copyright in the submitted photograph. However, by submitting an entry, the Participant grants to the Organiser, its related corporations, affiliates, successors, assigns, licensees, advertising agencies, media partners and authorised representatives a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable and sub-licensable licence to use, reproduce, publish, display, communicate, distribute, exhibit, adapt, crop, edit, modify, translate, create derivative works from and otherwise exploit the submitted photograph, whether in whole or in part, in any media, format or platform whether now known or developed in the future, for purposes connected with the Contest and the Organiser’s advertising, publicity, marketing, branding, corporate communications, social media, exhibition, archival and promotional activities, without further notice, consent, payment or compensation to the Participant.
   11. The Participant further represents, warrants and undertakes that the Organiser’s exercise of the rights granted under Clause 5.10 shall not infringe the rights of any third party, and the Participant shall execute all documents and do all acts as may be necessary to give full effect to the licence granted under Clause 5.10.
   12. The Organiser may, but shall not be obliged to, credit the Participant as the photographer when using any submitted photograph. The Participant waives, to the fullest extent permitted by law, any right to inspect, approve or object to any use, editing, adaptation, cropping, publication or reproduction of the submitted photograph by the Organiser in accordance with these Terms and Conditions.
   13. Without prejudice to the foregoing, the Participant agrees not to assert, enforce or object on the basis of any moral rights or similar rights in respect of the Organiser’s use, editing, adaptation, cropping, publication or reproduction of the submitted photograph in accordance with these Terms and Conditions.
6. Winner Selection
   1. Only entries that comply with these Terms and Conditions shall be eligible for judging.
   2. All valid entries will be evaluated and scored by the Organiser based on the following judging criteria:
      1. compliance with the relevant Contest Theme;
      2. creativity and visual impact;
      3. technical and artistic quality; and
      4. the extent to which the submitted photograph authentically and effectively portrays the distinctive features and character of the relevant Setia development.

      (collectively, the “Judging Criteria”).

   3. Subject to compliance with these Terms and Conditions and the Organiser’s final discretion, entries with the highest scores may be selected as winning entries (each, a “Winner”).
   4. For the avoidance of doubt, the Organiser may in its sole and absolute discretion disregard, mark down or disqualify any entry that, in the Organiser’s opinion, contains misleading, inaccurate, staged, excessively altered or otherwise unauthentic depictions of any Setia development, feature, facility or surrounding environment.
   5. In the event of a tie or where two or more entries receive the same or substantially similar scores, the Organiser shall have the sole and absolute discretion to determine the winning entry based on such additional criteria as the Organiser deems appropriate, including relevance to the Contest Theme, visual impact, authenticity, overall presentation and suitability for the Organiser’s branding and promotional purposes.
   6. The Organiser’s decision on all matters relating to the evaluation, scoring, ranking and selection of winning entries shall be final, conclusive, binding and no correspondence or appeal shall be entertained.
   7. The Organiser reserves the right not to award any Prize, or to award fewer Prizes than stated, if in the Organiser’s sole and absolute opinion, there are insufficient eligible entries, the entries do not meet the required standard, or it is otherwise inappropriate to award any Prize. The Organiser shall not be liable to any Participant for any loss, claim, cost or disappointment arising from the exercise of this right.
7. Disqualification
   1. The Organiser reserves the right, at any time and in its sole and absolute discretion, to disqualify any Participant and/or revoke, forfeit or reclaim any Prize awarded under the Contest if:
      1. the Participant is found to be ineligible or fails to satisfy any of these Terms and Conditions at any time during or after the Contest;
      2. the Participant or the Winner breaches any of these Terms and Conditions or violates any applicable laws, regulations or codes of conduct;
      3. any information, statement, declaration, consent, permission or document submitted or provided by the Participant is false, inaccurate, incomplete, misleading or incapable of verification to the Organiser’s satisfaction; or
      4. the Participant or the Winner engages in or is reasonably suspected by the Organiser of engaging in any conduct that undermines or may undermine the integrity or proper administration of the Contest, including but not limited to fraud, deception, cheating, forgery, dishonesty or any other unethical or improper behaviour or conduct.
   2. Without prejudice to any other rights or remedies of the Organiser, where any disqualification, revocation, forfeiture or reclaiming of prize occurs under Clause 7.1, the Organiser may require the Participant or the Winner (as the case may be) to return the prize (if applicable) in such manner and within such timeframe as may be specified by the Organiser; and/or where return of the prize is not possible, practical or appropriate, the Organiser may require the Participant or the Winner (as the case may be) to reimburse the Organiser for the full retail value of the prize, as determined by the Organiser in its sole and absolute discretion. The Organiser’s determination in such matters under Clause 7 shall be final, conclusive and binding, and no correspondence or appeal shall be entertained.
8. Warranties and Undertakings
   1. The Participant represents and warrants with the Organiser that:
      1. the Participant satisfies and shall continue to satisfy all Eligibility Criteria set out in these Terms and Conditions and shall, upon request, promptly provide such proof, information or supporting documentation as may be required by the Organiser;
      2. all information, statements, declarations and disclosures submitted or provided by the Participant to the Organiser are true, accurate, complete and not misleading in any respect;
      3. all identifiable persons appearing in the submitted photograph, if any, have given all necessary consents, permissions and releases for the submission of the photograph and the use of such photograph by the Organiser in accordance with these Terms and Conditions, and where any such person is below eighteen (18) years of age, the Participant has obtained the prior consent of such person’s parent or legal guardian; and
      4. the submitted photograph complies in all respects with these Terms and Conditions, including all requirements relating to authenticity, originality, file format, submission criteria and any restriction on AI-generated or AI-manipulated content, and the Participant shall, upon request by the Organiser, promptly provide the original file, RAW file and/or such other supporting evidence as the Organiser may require for verification purposes.
   2. In consideration of being permitted to participate in the Contest, the Participant unconditionally and irrevocably undertakes and agrees with the Organiser as follows:
      1. to fully cooperate and comply with all instructions, procedures, mechanisms and decisions issued by the Organiser in relation to the Contest;
      2. that the entitlement to participate in the Contest and/or receive any prize is conditional upon the Participant’s continued satisfaction of the Eligibility Criteria and full compliance with these Terms and Conditions, including representations, warranties, and undertakings given by the Participant;
      3. not to engage in any conduct, whether by act or omission, that may directly or indirectly prejudice, damage or bring into disrepute the Organiser, the Contest, development or project developed or undertaken by any of the companies within S P Setia Berhad group of companies;
      4. not, without the prior written consent of the Organiser, to publish or make any public statement regarding the Contest or any prize in any manner that purports to represent the Organiser or any statement that is false, misleading or prejudicial to the Organiser;
      5. not to make, publish or circulate any false, misleading, defamatory, disparaging or prejudicial statement concerning the Contest, the Organiser, S P Setia Group, any Setia development, any Prize, or any decision made by the Organiser; and
      6. not, without the prior written consent of the Organiser, to give any product or service endorsement, or participate in any interview, media engagement, publicity material or promotional report relating to the Contest or any prize, save where requested or approved by the Organiser.
9. Prizes
   1. A total of fifty-two (52) winning Participants will be selected for the Contest and awarded with cash prizes as set out below (each, a “Prize” and collectively, the “Prizes”).

   2. All Prizes are strictly non-transferable and/or non-exchangeable.
   3. The Winner shall be solely responsible for any taxes, duties, levies, charges, fees or other costs which may be imposed by any authority in connection with the Prize, unless otherwise determined by the Organiser. The Organiser shall not be responsible for providing any tax, financial or legal advice to any Winner.
   4. The Winner announcement and/or Prize giving ceremony may be conducted on or by 22 September 2026, or on such other date, time, mode or platform as may be determined by the Organiser at its sole and absolute discretion. The Organiser may notify the Winner using the contact details provided in the respective submissions.
   5. The Organiser may notify a Winner using the contact details submitted by the Participant. If a Winner cannot be contacted, fails to respond, fails to provide the required documents, fails to verify eligibility or fails to claim the Prize within the timeframe prescribed by the Organiser, the Organiser reserves the right to forfeit the Prize and/or select an alternative Winner, without any liability to the original Winner.
   6. The Organiser reserves the right, at any time and at its sole discretion, to discontinue showcasing, displaying or exhibiting any winning photograph or entry at any location and in any manner as the Organiser may deem fit.
   7. The Organiser reserves the right at any time to replace, withdraw, cancel, alter, vary or substitute any Prize with any other prize of such value and type as the Organiser may determine at its sole and absolute discretion, without prior notice or assigning any reason.
10. General Rules
    1. The rights and obligations of a Participant under the Contest are personal and non-transferable. A Participant shall not transfer, assign or otherwise deal with any such rights or obligations without the prior written consent of the Organiser. The Organiser reserves the right to assign, transfer, sub-license or otherwise deal with any part of its rights under these Terms and Conditions to any third party as it deems appropriate.
    2. The Participant agrees that, if requested by the Organiser, the Participant shall make himself/herself available for interviews, photography, audio and/or video recordings (collectively, the “Recordings”) for promotional, advertising and publicity purposes.
    3. The Participant irrevocably agrees and consents to the Organiser:
       1. The Participant agrees that, if requested by the Organiser, the Participant shall make himself/herself available for interviews, photography, audio and/or video recordings (collectively, the “Recordings”) for promotional, advertising and publicity purposes; and
       2. own all intellectual property rights in the Recordings for promotional, marketing and publicity purposes, without further compensation.
    4. Participation in the Contest shall not create or be deemed to create any employment, agency, partnership, joint venture, service provider, contractor or representative relationship between the Participant and the Organiser. the Participant shall not be entitled to any wages, salary, fees, remuneration or other compensation by reason only of their participation in the Contest, except for any Prize awarded in accordance with these Terms and Conditions.
    5. By participating in the Contest, the Participant irrevocably agrees to:
       1. release, discharge and hold harmless the Organiser, its related corporations, affiliates, and their respective directors, officers, employees, agents, representatives, contractors, service providers, licensees, successors and assigns from and against any and all claims, demands, actions, proceedings, liabilities, losses, damages, costs, expenses, injuries or causes of action of any kind, whether direct or indirect, arising from or in connection with the Participant’s participation in the Contest, submission of any entry, attendance at any Contest-related activity, acceptance, possession, use or misuse of any Prize, or the Organiser’s use of any submitted photograph or Recordings in accordance with these Terms and Conditions, to the fullest extent permitted by law.
       2. indemnify and keep indemnified the Organiser, its related corporations, affiliates, and their respective directors, officers, employees, agents, representatives, contractors, service providers, licensees, successors and assigns against any and all claims, demands, actions, proceedings, liabilities, losses, damages, costs and expenses, including legal costs on a solicitor-client basis, arising from or in connection with: (a) any breach of these Terms and Conditions by the Participant; (b) any breach of any representation, warranty or undertaking given by the Participant; (c) any infringement or alleged infringement of any intellectual property rights, privacy rights, image rights, personal data rights, moral rights or other rights of any third party arising from or in connection with the submitted photograph, Recordings or any information or material provided by the Participant; (d) any claim by any person appearing in, identified in, or otherwise connected with any submitted photograph or Recordings; (e) any false, inaccurate, incomplete or misleading information, declaration, consent, permission or document provided by the Participant; (f) any fraud, negligence, wilful misconduct, omission or unlawful act by the Participant; and (g) the Participant’s acceptance, possession, use or misuse of any Prize.
    6. The Organiser reserves the right, at any time and at its sole and absolute discretion, to vary, shorten, extend, terminate, suspend or cancel the Contest, whether in whole or in part, without prior notice or assigning any reason.
    7. In the event the Contest is varied, shortened, extended, suspended, terminated or cancelled, the Organiser shall not be liable to any Participant for any loss, damage, cost, expense, claim or disappointment arising from or in connection with such variation, shortening, extension, suspension, termination or cancellation, and no compensation, replacement or substitution shall be payable unless otherwise determined by the Organiser at its sole and absolute discretion.
    8. The Organiser shall not be liable for any loss, damage, cost or expense of any nature suffered or incurred by any Participant arising out of or in connection with the Contest, the participation in the Contest, the submission of any entry or the acceptance, possession or use of any Prize, to the fullest extent permitted by law.
    9. The Organiser shall not be responsible or liable for any entry that is lost, delayed, misdirected, incomplete, corrupted, inaccessible, illegible or not successfully submitted due to any technical error, network failure, system malfunction, platform downtime, transmission failure, server issue, internet connectivity issue, human error or any other reason beyond the Organiser’s reasonable control. Proof of submission shall not constitute proof of receipt by the Organiser.
    10. These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia and the parties submit to the exclusive jurisdiction of the courts of Malaysia.
11. Privacy
    1. The Organiser shall not be responsible or liable for any entry that is lost, delayed, misdirected, incomplete, corrupted, inaccessible, illegible or not successfully submitted due to any technical error, network failure, system malfunction, platform downtime, transmission failure, server issue, internet connectivity issue, human error or any other reason beyond the Organiser’s reasonable control. Proof of submission shall not constitute proof of receipt by the Organiser.
    2. By participating in the Contest, the Participant expressly consents to the collection, recording, holding, storage, use, disclosure, transfer and processing of the Participant’s personal data by the Organiser, its related corporations, affiliates, service providers, agents and authorised representatives for purposes relating to the Contest, including verification of eligibility, administration of entries, judging, winner selection, prize fulfilment, publication of winner details, publicity, marketing, promotional activities, audit, record-keeping and compliance with legal or regulatory requirements. The Organiser’s applicable personal data and privacy policy is as set out at http://www.spsetia.com.my/terms-and-conditions/privacy-policy.htm (as may be amended from time to time).
    3. The Participant warrants that all personal data provided to the Organiser is true, accurate, complete and up to date. Where the Participant provides personal data of any third party, including any person appearing in a submitted photograph, the Participant warrants that the Participant has obtained the necessary consent from such third party for the Organiser to process such personal data in accordance with these Terms and Conditions.
    4. The Participant may withdraw consent to the processing of personal data by giving written notice to the Organiser. However, such withdrawal may result in the Participant being disqualified from the Contest and/or forfeiting any Prize entitlement where the relevant personal data is required for the administration of the Contest or fulfilment of the Prize. The Organiser shall not be liable for any loss or damage arising from such disqualification or forfeiture.
